CLARIFICATION TEXT FOR DENT48 MOUTH AND HEALTH POLYCLINICS INTERNET SITE REGARDING THE LAW ON THE PROTECTION OF PERSONAL DATA NUMBERED 6698

Purpose and Scope of the Clarification Text

As Dent48 Oral and Dental Health Polyclinics, we take measures to protect your personal data within the scope of the Personal Data Protection Law No. 6698 (hereinafter referred to as " personal data protection law" or "Law"). We process your Personal Data within the scope of personal data protection law and relevant legislation and in our capacity as "data controller" for the reasons and methods described below.

Dent48 Oral and Dental Health Polyclinics Clarification Text on the Processing of Personal Data, in accordance with the article titled "Data Controller's Obligation to Inform" in Article 10 of the personal data protection law; It has been prepared in order to inform you in the most transparent way about the identity of the data controller, the method and legal reason for collecting your personal data, the purpose for which this data will be processed, to whom and for what purpose it can be transferred, the data processing period and your rights listed in Article 11 of the personal data protection law. The explanations made for "Your Personal Data" in the clarification text also cover "Your Personal Data of Special Nature".

Your personal data may be collected verbally, in writing or electronically by automatic or non-automatic methods, the Company's affiliated units, website, social media channels, call centre, mobile applications and similar means. Your personal data may be processed by creating and updating as long as your relationship with the Company continues and may be kept in both digital and physical environment.

Your personal data may be processed and transferred in line with the purposes set out in the heading "Your Personal Data and Processing Purposes" and within the scope of the personal data processing conditions and purposes specified in subparagraphs "c, e and f" in accordance with paragraph 1 of Article 5 of Law No. 6698 or paragraph 2 of Article 5.

Digital Data: Camera system image and sound recordings taken during your visit to our hospitals, voice call recordings kept if you contact our call centre,

Other:  Sağlık hizmetlerinizin finansmanı ve planlaması amacıyla özel sağlık sigortasına ilişkin verileriniz ve Sosyal Güvenlik Kurumu verileriniz,  Web siteniz ve mobil uygulamamızı kullanımınız sırasında elde edilen gezinme bilgileri, IP adresi, tarayıcı bilgileri ve kendi rızanız ile ilettiğiniz tıbbi belgeler, anketler, form bilgileri ve konum verileri.

Your personal data collected;;

To enable our relevant business units to carry out the necessary work for real or legal third parties, institutions and organisations (employees, visitors, suppliers, business partners, etc.) who have a relationship with the Company to benefit from the products and services of our Company and the Centres and units affiliated to our Company,

Fulfilment of legal and regulatory requirements arising/may arise from all relevant laws and secondary regulations and taking necessary measures in this context,

Execution of inspection and regulation duties to be carried out by the public institutions and organisations in charge and authorised public institutions and organisations and professional organisations having the status of public institutions,

Fulfilment of information and document requests by judicial bodies and administrative authorities,

To carry out listing, reporting, verification and analysis studies on the use of the products and services offered in our company and all centres and units affiliated to the company, to produce statistical and scientific information in this regard, to improve our products and services accordingly, to increase satisfaction with our products and services and to make customisations regarding the user in this context,

To be able to carry out market research, promotion and necessary information about our products and services, to evaluate complaints and suggestions and to contact you directly through the communication channels shared with the Company,

Taking all necessary technical and administrative measures for systems and applications within the scope of data security purposes, within the personal data processing conditions and purposes specified in Articles 5 and 6 of Law No. 6698.

Your personal data listed above and your special categories of personal data may be processed for the following purposes;

Protection of public health, preventive medicine, medical diagnosis, treatment and care services,

Sharing the information requested with the Ministry of Health and other public institutions and organisations in accordance with the relevant legislation,

Fulfilment of legal and regulatory requirements,

Financing of my health services by the Patient Services, Financial Affairs, Marketing departments, covering your examination, diagnosis and treatment expenses, sharing the information requested with private insurance companies within the scope of eligibility enquiry,

To be informed about your appointment through our Call Centre and Digital Channels,

Planning and management of the internal functioning of the organisation by the Hospital Management,

Planning and management of the internal functioning of the organisation by the Hospital Management,

Analyses by Quality, Patient Experience, Information Systems departments to improve health services,

Monitoring and prevention of fraud and unauthorised transactions by Audit and Information Systems departments,

Fulfilment of risk management and quality improvement activities by Quality, Patient Experience, Information Systems departments,

Invoicing for your services by Patient Services, Financial Affairs, Marketing departments, confirming my relationship with the institutions contracted with your hospital by Patient Services, Financial Affairs, Marketing departments, responding to all kinds of questions and complaints regarding the health services provided / to be provided to you by Hospital Management, Patient Experience, Patient Rights, Call Centre departments,

Taking all necessary technical and administrative measures within the scope of data security of your hospital's systems and applications by Hospital Management, Information Systems departments, Participation in campaigns and providing campaign information by Marketing, Media and Communication, Call Centre departments, Designing and communicating special content, concrete and intangible benefits on web and mobile channels, Measuring, increasing and researching patient satisfaction by Hospital Management, Patient Rights, Patient Experience departments.

By ensuring that all necessary technical and administrative measures are taken to ensure the appropriate level of security in accordance with the personal data protection law and the relevant legislation, your Personal Data / Personal Data for the purposes stated above;

According to Article 8 of the personal data protection Law, in the presence of one of the conditions specified in the second paragraph of Article 5 of the personal data protection law and within the framework of the personal data processing conditions and purposes specified in Article 9 of the personal data protection law, it can be transferred by providing the explicit consent condition

Within the scope of the Transfer of Personal Data, your personal data may be transferred within the framework of the Basic Law on Health Services No. 3359, the Decree Law No. 663 on the Organisation and Duties of the Ministry of Health and its Affiliated Institutions, the Law on the Protection of Personal Data No. 6698, the Regulation on Private Hospitals, the Regulation on the Processing of Personal Health Data and the Protection of Privacy and the regulations of the Ministry of Health and other legislation provisions and for the purposes described above; 

Ministry of Health, sub-units affiliated to the ministry and family medicine centres,

Social Security Institution,

General Directorate of Security and other law enforcement agencies,

General Directorate of Population,

Pharmacists Association of Turkey,

Judicial authorities,

The legal representatives you have authorised,

Private insurance companies,

Third parties with whom you have received advice, including lawyers, tax advisors and auditors,

Another hospital to which the patient has been referred or to which the patient has self-referred,

Regulatory and supervisory bodies and public authorities,

It will be shared with suppliers, support service providers, archive service providers and business partners whose services you benefit from as a company or with whom we cooperate.

We inform you that my personal data are collected and processed in all kinds of verbal, written, visual or electronic media for the above-mentioned purposes and for the execution of all kinds of business within the scope of Dent48's field of activity within the legal framework and for Dent48 to fully and duly fulfil its contractual and legal obligations in this context.

I have read the above-mentioned information and the legal reason for the collection of my personal data by Dent48 as explained in detail above;

Decree Law No. 663 on the Organisation and Duties of the Ministry of Health and its Affiliated Institutions, Regulation on Private Hospitals,

Regulation on Processing and Protection of Privacy of Personal Health Data,

Ministry of Health regulations and other legislative provisions.

In addition, as stated in paragraph 3 of Article 6 of the Law, personal data related to health and sexual life can only be processed by persons or authorised institutions and organisations under the obligation of confidentiality for the purposes of protecting public health, preventive medicine, medical diagnosis, treatment and care services, planning and management of health services and financing, without seeking my explicit consent.

Data Processing Period and Storage Period

Your personal data, limited to the purposes specified in this Clarification Text; It will be processed by complying with the data processing and statute of limitations periods specified in all relevant laws and other legal legislation to which our Company and the centres and units affiliated to our Company are subject. In case of changes in the laws regarding data processing periods, the new periods determined will be taken as basis.

As a requirement of the principle of purpose limitation, your personal data is processed limited to the time required to fulfil the purposes described in this Clarification Text and in any case in accordance with the practices and customs of the Company's practices and commercial life, and after the expiration of the periods, it is deleted, destroyed or anonymised. In this context, the retention period of process-based personal data is stated below:

Rights of the data subject

To learn whether my personal data is being processed,

Request information if my personal data has been processed,

Access to and request for my personal health data,

To learn the purpose of processing my personal data and whether they are used in accordance with their purpose,

To know the third parties to whom my personal data is transferred domestically or abroad,

To request correction of my personal data in case of incomplete or incorrect processing,

Request deletion or destruction of my personal data,

In the event that my personal data is incomplete or incorrectly processed, to request that the third parties to whom my personal data is transferred be notified of the transactions regarding the correction of these and/or the deletion or destruction of my personal data,

To object to the emergence of a result to my detriment by analysing my processed data exclusively through automated systems,

The right to demand compensation for damages in case I suffer damage due to unlawful processing of my personal data,

As the data subject, you may exercise your rights under Article 11 of the Law regulating the rights of the data subject by submitting your requests in writing to the address "Orhaniye Mah İsmet Çatak Cad No: 12/1 Menteşe Muğla" or electronically to the e-mail address info@dent48.com in accordance with the "Communiqué on Application Procedures and Principles to the Data Controller". Şirket’in müşterilerine sunmuş olduğu ürün ve hizmetlerini en iyi koşullar altında sağlayabilmesi, ürün veya hizmetlerin güvenilir ve kesintisiz bir şekilde temin edilmesi, müşteri memnuniyetinin en üst seviyeye çıkarılması, mezkûr hizmetlere ilişkin çeşitli işlemlerin yerine getirilmesi, operasyonların yürütülmesi ve geliştirilmesi, mezkûr ürün ve hizmetlerin veya farklı ürün ve hizmetlerin tanıtım, pazarlama, reklam ve kampanya faaliyetlerinin yapılması, müşterilerin fırsatlardan, kampanyalardan ve sair hizmetlerden haberdar edilmesi amacıyla tarafınıza sms mesajı ve/veya e-posta gönderilmesi ve mobil iletişim kurulması ve müşterilerle akdedilen sözleşmelerin gereklerinin yerine getirilmesi amaçlarıyla doğrudan veya dolaylı olarak ilgili olan kimlik bilgilerinin, adres bilgilerinin, iletişim bilgilerinin ve sair kişisel verilerin; başta mevzuatta öngörülen veya işlendikleri amaç için gerekli olan süre kadar muhafaza edilme ilkesi olmak üzere 6698 Sayılı Kişisel Verilerin Korunması Kanunu’nun (“KVK Kanunu”) 4. maddesinde ifade edilen genel ilkelere uygun şekilde işlenebileceğini; elde edilebileceğini, kaydedilebileceğini, işlenme amacıyla uygun süre zarfında fiziksel veya elektronik ortamda güvenli bir şekilde depolanabileceğini, muhafaza edilebileceğini, değiştirilebileceğini, yeniden düzenlenebileceğini, mevzuata uygun biçimde açıklanabileceğini ve aktarılabileceğini, devralınabileceğini, sınıflandırılabileceğini, işlenebileceğini ya da verilerin kullanılmasının engellenebileceğini; yukarıda belirtilen hususlarla ilgili olarak Şirket tarafından bilgilendirildiğimi ve KVK Kanunu çerçevesinde açık rızam bulunduğunu kabul ve beyan ederim.
